Terms and Conditions

By creating a profile on the Global Grad platform you are accepting and gaining access to the Service, You agree to be bound by these terms of use (Terms) and agree that at all times Your use of the Service will be governed by, and must comply with, these Terms and the applicable UQ policies and associated procedures and guidelines, including PPL 6.20 ‘Acceptable Use of ICT Resources’. We may amend these Terms from time to time by presenting you with a new version of these Terms when you next access the Service and requiring you to accept the new version of the Terms before making any further use of the Service. These Terms revoke any earlier version of the Terms.  1. DEFINITIONS In these Terms: "Eligible End User", means students who have enrolled in, or are graduates of UQ, who are permitted by UQ to access and use the Service; "Employer", means a person or entity seeking to employ any students who have enrolled in, or are graduates of UQ;  "Licensor", means GradConnection Pty Ltd (ACN 131 597 932); Service, means the employment market place facility hosted by the Licensor and delivered via a software-as-a-service model, through which Employers’ advertisements can be listed and Eligible End Users can access and respond to such advertisements; and the Service includes any updates or new releases, modifications, enhancements, and documentation associated with it; "UQ / We / Us", means The University of Queensland, (ABN 63 942 912 684), a body corporate established under "The University of Queensland Act 1998", of Brisbane, Queensland, 4072; "User Data", means the personal content You have uploaded to the Service; and "You / Your", means the person whose UQ account details have been entered as part of accessing the Service. 2. PERMITTED USE 2.1 The Licensor has permitted UQ to provide You with access to, and use of, the Service subject to your compliance with these Terms. 2.2 You may only access the Service if You are an Eligible End User. 2.3 You must only store content on the Service that is related to Your career search purposes or researching prospective Employers, and You acknowledge that the amount of storage space made available to You may be adjusted at any time without prior notice. 3. RESTRICTIONS ON USE 3.1 Except as otherwise expressly permitted in these Terms, You  must not:  a) modify or create any derivative works of the Service; b) decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for the Service (except to the extent applicable laws specifically prohibit such restriction);  c) redistribute, encumber, sell, rent, lease, sub-license, or otherwise transfer rights to the Service;  d) remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels in the Service;  e) publish any results of benchmark tests run on the Service to a third party without the Licensor’s prior written consent; or f) upload to the Service, or cause to be stored on the Service, any User Data that infringes UQ policy PPL 6.20.01 ‘Acceptable Use of ICT Resources’ or associated guidelines. 3.2 We reserve the right to terminate your account or to remove, or prevent access to, any content uploaded by You to the Service, which in our reasonable opinion does not comply with the restrictions set out in these Terms, or otherwise in our sole discretion. The rights set out in this clause may be exercised by Us or the Licensor. 4. CHANGES TO THE SERVICE  4.1 You acknowledge that the Service is continually being improved and updated and that features of the Service may be changed, including by the discontinuation of particular features, at any time with or without notice to You. 4.2 You acknowledge that Your access to and use of the Service may be restricted, which may include limits placed on the duration and amount of use You are permitted to make of the Service, at any time, with or without notice to You.     5. DISCLOSURE OF INFORMATION 5.1 Both UQ and the Licensor will comply with "Information Privacy Act 2009" (QLD) (the "Act") in all dealings with Your Personal Information (as defined in the "Act") stored in the Service, however You must be aware of Your own responsibility in protecting Your own and others’ Personal Information and confidential information in connection with Your use of the Service. 5.2 You acknowledge that by using the Service You may publish content on the Service or to the World Wide Web at large, and that any information you disclose will be available to certain other end users including Employers, and may be collected and used by persons other than UQ and the Licensor.  5.3 You acknowledge in connection with Your use of the Service that: a) You are responsible for Your choice to disclose any information;  b) You are aware You should not disclose any information that You do not want others to know;  c) neither UQ nor the Licensor monitors the Service routinely and You use the Service at Your own risk; and d) You are aware that once you have disclosed information to a third party, including an Employer, neither UQ nor the Licensor can control how the recipient third party deals with that information.  6. THIRD PARTY CONTENT 6.1 The Service may contain links to third party websites. When you click on these links, you will leave the Service, and will then be subject to the terms of use and information collection practices of such third parties. Neither UQ nor the Licensor has control over the content, policies or actions of these third parties.  6.2 The Service may contain content, including advertisements, uploaded by third parties, including by Employers. You acknowledge that neither UQ nor the Licensor endorses such content and neither UQ nor the Licensor will be liable to You in any way in connection with such content. 7. NO WARRANTIES 7.1 You acknowledge that You have been given access to the Service free of charge. 7.2 Subject to clause 7.5, neither UQ nor the Licensor warrant that the Service will operate without fault or interruption and you acknowledge that access to the Service is provided on an ‘As Is’ basis. 7.3 To the extent permitted by law, excluded from these Terms are all terms, conditions, guarantees, warranties and the like (whether legislative or otherwise) which would or might otherwise be implied into these Terms or otherwise made applicable to Your use of the Service.   7.4 Subject to clause 7.5, neither UQ nor the Licensor will be liable to You in connection with these Terms or the provision or content of the Service, under any legal theory (including negligence), even if that loss was reasonably foreseeable by the relevant party or that party had been advised of the possibility of that loss arising. 7.5 Nothing in these Terms will exclude, restrict or modify any condition, guaranty, warranty or liability which may at any time be implied by the "Competition and Consumer Act 2010" (Cth) or any other law where to do so is illegal or would render any provision of these Terms void. 7.6 To the extent permitted by law, UQ’s liability in connection with these Terms and the provision of the Service, for a breach of an implied term, condition, guarantee or warranty is limited to UQ’s choice of the re-supply of the relevant service or the cost of having the relevant service supplied again. 8. YOUR USER DATA 8.1 During Your use of the Services and when You terminate your account or cease being an Eligible End User, You are responsible for downloading a copy of Your User Data that is stored on the Service. You acknowledge that neither UQ nor the Licensor will be responsible for storing or keeping a copy of Your User Data following termination of Your account.  8.2 Where You are no longer an Eligible End User, or Your account for use of the Service has been terminated, you acknowledge that: a) UQ or the Licensor may move Your User Data off the Service to an external storage medium or delete it; and b) You may request to be provided with access to Your account, if it is still available, to allow You to download a full copy of Your User Data; or that your User Data is deleted from the Service , by contacting the UQ Careers Service  [careers@uq.edu.au]. 8.3 You acknowledge that Your User Data may be retained until You instruct Us to delete Your User Data. 9. TERMINATION 9.1 You may terminate your account at any time. 9.2 We reserve the right to terminate or suspend your access to the Service at our sole discretion, at any time, without liability and without prior notice to You, subject to applicable UQ policies, or where required under our agreement with the Licensor.  10. GENERAL TERMS 10.1 To the full extent permitted by law, these Terms are to be construed in accordance with the laws in force in the State of Queensland, Australia. 10.2 You must not assign this agreement or any part without UQ’s prior written consent. 10.3 If any provision of these Terms is void, voidable or unenforceable, it is to be read down so as to be valid, and if it cannot be read down then it is to be severed in the relevant jurisdiction (without affecting the remainder of these Terms), unless and to the extent this would fundamentally alter these Terms or be contrary to public policy. 10.4 In these Terms, a word denoting the singular includes the plural and vice versa; a reference to a person includes a natural person, corporation, partnership, joint venture, trust, authority, government body and any other legal entity; a reference to these Terms or another document or any law is to these Terms or other document or law as varied, supplemented or replaced from time to time; a reference to a party includes that party's executors, administrators, successors and permitted assigns; where a word or phrase is given a particular meaning, other parts of speech or grammatical forms of that word or phrase have corresponding meanings; headings are for convenience and do not affect interpretation; and the terms ‘includes’ and ‘including’ are not to be read as words of limitation. The Global Grad platform is provided to you by the University of Queensland as a means for accessing information on international job vacancies. Please note that organisations using the Global Grad platform do not have a partnership with the University of Queensland (UQ) nor are they and/or their vacancies endorsed by UQ. As such you are encouraged to research and verify information about an organisation and/or vacancy before you undertake an application. Some of the criteria that you should verify include: your suitability for the role, the wage/salary provided, location of the job vacancy and visa/residency requirements for the positions. Please be advised that selection criteria and eligibility for an international role may be very different from those of an Australian vacancy, and will be determined by the local legal framework and customs of the host country.
